House rules and terms of use
§ 1 Scope
(1) The following provisions apply to contracts for the use of the services offered by Roetgen Therme Verwaltungs GmbH (hereinafter referred to as ‘ROETGEN THERME’) by its guests at ROETGEN THERME.
§ 2 Stay at ROETGEN THERME
(1) Notwithstanding the following paragraphs (2) and (3), the following persons are not permitted to enter ROETGEN THERME for reasons of infection control:
a) Persons who are subject to isolation requirements
b) Persons who do not meet the requirements arising from the applicable laws, regulations, general decrees or orders in individual cases, or who cannot or do not wish to provide proper proof of these requirements.
(2) Only persons who intend to conclude a contract with ROETGEN THERME are permitted to stay. The same applies to persons who bring other persons (e.g. children) to ROETGEN THERME for this purpose or pick them up from there, as well as to persons who visit ROETGEN THERME at the invitation or with the special permission of ROETGEN THERME. Staying for other purposes is not permitted.
(3) Staying in the entire building complex is only permitted during opening hours (§ 5) and only for guests who have the appropriate access authorisation (§ 3).
§ 3 Conclusion of contract, access authorisation, age restrictions
(1) The contracting parties are ROETGEN THERME and the guest.
(2) A contract between ROETGEN THERME and the guest is only concluded when ROETGEN THERME accepts the guest's offer. The offer is accepted when the cashier staff hands the guest an access authorisation in the form of a transponder upon presentation of a valid ticket. The guest is obliged to return the transponder handed to them before leaving ROETGEN THERME. All food and beverages are booked on this transponder.
(3) ROETGEN THERME only accepts offers from guests if they do not contravene the following age restrictions:
a) Sauna
Only persons aged 16 and over are permitted to enter the clothing-optional ‘sauna area’. Persons under the age of 16 may only enter the clothing-optional ‘sauna area’ when accompanied by a responsible adult.
Paragraph (4) remains unaffected.
(4) Guests have no right to demand that ROETGEN THERME accept their offer to conclude a contract. ROETGEN THERME reserves the right to reject the offer for operational (e.g. due to excessive visitor numbers) or other objective reasons. Other objective reasons include, in particular, if, based on the specific circumstances of the individual case, there is serious concern that the guest
a) will violate the following provisions;
b) would endanger themselves or others during their stay at ROETGEN THERME as a result of their physical, mental or other condition.
§ 4 Prices
(1) ROETGEN THERME charges different admission fees for use of the sauna area. If the respective tariff provides for a limited length of stay, exceeding this limit will result in an increase in the admission fee.
(2) Admission authorisation is non-transferable. It is not permitted to make admission authorisation available to another guest for use, either for a fee or free of charge, or to have another guest's admission authorisation made available to you for use, either for a fee or free of charge. Making access authorisation available for use is defined as transferring possession of the access authorisation in order to enable oneself or another guest to use the entire area in breach of contract without paying the admission fee charged by ROETGEN THERME. Violations will be prosecuted under criminal and civil law.
(3) If the guest loses the transponder, a fee of €30.00 will be charged; if the guest loses the key to the locker and the locker has to be opened by staff, a fee of €40.00 will be charged.
§ 5 Opening hours
ROETGEN THERME shall announce the opening hours by means of notices.
§ 6 Contractual obligations of ROETGEN THERME
By entering into the contract, ROETGEN THERME undertakes to grant the guest the opportunity to use the services offered within the premises within the scope of their access authorisation. The possibility of use extends to the areas, facilities and equipment dedicated to guest traffic, unless these are temporarily closed by ROETGEN THERME for operational or other objective reasons or are not available to the guest in a specific case due to the exhaustion of their spatial capacity or numerical quota; The guest's rights and claims arising from the statutory provisions remain unaffected.
§ 7 General contractual obligations of the guest
(1) By entering into the contract, the guest undertakes to pay ROETGEN THERME the agreed admission fee for their stay. They also undertake to pay ROETGEN THERME any additional charges for
a) exceeding the length of stay specified in the tariff, or
c) the use of other additional services subject to a charge (such as food or beverages).
(2) The guest undertakes by virtue of the contract to
a) carry their access authorisation (transponder) with them at all times;
b) to show it to ROETGEN THERME employees and other agents upon entering the building and upon request at any time, and to hand it over for inspection purposes if necessary;
c) to treat the areas, facilities and equipment of ROETGEN THERME with care and not to contaminate them;
c) to behave in such a way that he
- does not endanger themselves or others;
- does not harass, disturb or offend other guests. They must refrain from any behaviour that is considered inappropriate according to social rules and customs;
- observe the warning signs and other behavioural instructions posted by ROETGEN THERME;
- comply with requests made by employees and other agents of ROETGEN THERME in connection with their stay at ROETGEN THERME;
- for hygienic reasons, wash themselves in the designated shower rooms after removing their outdoor clothing;
- not to commit any criminal offences or administrative offences to the detriment of other guests or ROETGEN THERME. If ROETGEN THERME becomes aware of any circumstances that give rise to the suspicion that a guest has committed a criminal offence or administrative offence at ROETGEN THERME, it shall report these circumstances to the competent authority. Further steps taken by ROETGEN THERME against anyone suspected of committing a criminal offence or administrative offence at ROETGEN THERME remain unaffected by this.
§ 8 Prohibitions
(1) Guests are prohibited from engaging in sexual acts on themselves or other guests at ROETGEN THERME, or from allowing other guests to engage in sexual acts on themselves.
(2) Guests are not permitted to bring any kind of food or drink (including sweets) into the ROETGEN THERME, to consume such items, or to consume food or drink brought in by other guests.
This prohibition does not apply to food and beverages
a) that a guest requires for medical or other reasons or is restricted to (e.g. due to allergies or food intolerances);
b) that are objectively intended for newborns, infants or young children (e.g. bottled milk, jarred food, porridge).
ROETGEN THERME undertakes to provide guests with beverages, food and luxury foods and to offer them at reasonable prices. Reasonableness is assessed on the basis of whether the prices are in line with market standards in the catering industry.
(3) Guests are not permitted to bring the following items into ROETGEN THERME or to carry them there:
a) Narcotics of any kind, with the exception of prescription medication prescribed to the guest by a doctor;
b) Containers made of glass, porcelain, ceramics or other fragile materials; if food or beverages are served to the guest in such containers in the catering area of ROETGEN THERME, they may only be used for their intended purpose and only within the catering facility;
c) Animals; for hygienic reasons, this prohibition also applies to animals whose purpose is to compensate for disadvantages that may arise from a person's physical or mental condition (e.g. guide dogs);
d) Knives or other dangerous objects; dangerous objects are all tools and substances which, in view of their material, composition and/or other properties, are suitable for
- to be used against a person in such a way as to cause serious injury (e.g. screwdrivers, hammers, batons, baseball bats); if a knife is made available to guests in the catering facilities of ROETGEN THERME, it may only be used for its intended purpose and only within the catering facilities;
- to impair the physical integrity of a person (e.g. corrosive liquids).
(4) Smoking is not permitted outside the designated areas. The smoking ban also extends to the use of all types of so-called electronic cigarettes.
(5) Subject to prior written approval from ROETGEN THERME, it is not permitted to
a) Displaying, attaching or distributing advertising brochures, flyers, printed matter or similar items;
b) Undertaking activities intended to serve the commercial interests of the guest or a third party;
c) Holding meetings or calling for such meetings;
d) Undertaking activities aimed at spreading political, religious or ideological beliefs or serving the formation of political opinion;
d) to carry out activities aimed at spreading political, religious or ideological beliefs or serving the formation of political opinion;
e) to carry out signature or donation campaigns.
§ 9 Supervisory duties
(1) Parents are responsible for supervising their children. This duty is not waived by the fact that ROETGEN THERME employs staff to identify and avert dangers as part of its duty to ensure public safety. Parents are responsible for ensuring that their children do not come to harm during their entire stay at ROETGEN THERME. In addition, parents must ensure that their children do not violate the provisions of these house and usage rules.
(2) The obligations set out in the preceding paragraph (1) also apply to anyone to whom a child has been entrusted for supervision during their visit to ROETGEN THERME.
(3) ROETGEN THERME's liability in accordance with § 14 is not affected by the preceding paragraphs (1) and (2).
§ 10 Use of lockers and storage compartments, bringing in valuables
(1) ROETGEN THERME provides guests with lockers for storing their clothing and storage compartments for storing valuables free of charge. The lockers and storage compartments are designed so that they can be opened and closed with a key.
(2) ROETGEN THERME shall make reasonable efforts to prevent unauthorised persons from forcibly opening lockers and cubicles. Due to their design and intended purpose, the lockers and cubicles are not constructed in such a way that they can withstand attempts to open them by force with sufficient certainty on a permanent basis. In their own interest, guests should therefore refrain from placing valuables in lockers or cubicles.
(3) It is the guest's responsibility to take the necessary care to ensure that unauthorised persons do not gain possession of the key to the locker or cupboard provided to them and thereby gain access to the contents of the locker or cupboard.
(4) In the event that the guest suffers damage in connection with the opening of lockers or safes by an unauthorised person, ROETGEN THERME's liability shall be governed by § 14. In all other respects, we refer to the fees specified in § 2 (3).
§ 11 Video surveillance
Video surveillance is in operation in the locker area at reception and in other areas of ROETGEN THERME. This is indicated by signs at the locations concerned, which also provide the information required under data protection law.
§ 12 Violations of the house and usage rules, disclosure of personal details
(1) If a guest violates the provisions of the house and usage rules, ROETGEN THERME is entitled, taking into account all circumstances of the individual case, in particular the nature, severity and duration of the violation and its consequences, to exclude the guest from further use for the respective day and to expel them from ROETGEN THERME. The guest's rights and claims arising from the statutory provisions remain unaffected.
(2) If, based on objective facts, there is a risk that a guest will violate the provisions of the house and usage rules in the future, ROETGEN THERME is entitled, taking into account all circumstances of the individual case, to exclude the guest from use for a longer period of time (hereinafter referred to as ‘ban from the premises’). The duration of the ban shall be determined by ROETGEN THERME at its reasonable discretion. ROETGEN THERME shall hear the guest before imposing a ban. The guest's rights and claims under the statutory provisions shall remain unaffected.
(3) In the event of a violation of the house rules or a suspicion of such a violation based on actual evidence, the guest shall provide ROETGEN THERME with their personal details (surname, first name, address for service) and identify themselves with suitable documents (e.g. identity card, driving licence). No copy of the documents shall be made.
(4) The guest shall also provide identification in accordance with the above paragraph (3) and provide ROETGEN THERME with the data specified therein if ROETGEN THERME has a legal interest in knowing this data. A corresponding legal interest exists in particular if this data is necessary for the assertion, exercise or defence of rights or claims of ROETGEN THERME.
§ 13 Liability of the guest
If the guest culpably breaches an obligation arising from the contractual relationship between him and ROETGEN THERME, he shall be liable to ROETGEN THERME for damages in accordance with the statutory provisions. The same applies to culpable breaches of duty by persons for whom the guest is responsible by law.
§ 14 Liability of ROETGEN THERME
(1) ROETGEN THERME shall be liable to the guest in accordance with the statutory provisions for damage to life, limb and health resulting from a culpable breach of duty by ROETGEN THERME, its legal representatives or its vicarious agents. Furthermore, ROETGEN THERME shall be liable to the guest in accordance with the statutory provisions for other damages resulting from intentional or grossly negligent breaches of duty by ROETGEN THERME, its legal representatives or its vicarious agents.
(2) If damage is based on a simple negligent breach of a material contractual obligation, i.e. an obligation whose fulfilment is essential for the proper execution of the contract and on whose compliance the guest, as a contractual partner of ROETGEN THERME, may regularly rely, ROETGEN THERME's liability shall be limited to the damage foreseeable at the time of conclusion of the contract and typical for this type of contract. The same applies if the guest is entitled to claims for damages instead of performance.
(3) Otherwise, Roetgen Therme shall not be liable to the guest for damages.
§ 15 Final provisions
Should individual provisions of these house and usage rules be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
